PROCESS FOR FILING A SEXUAL HARASSMENT/DISCRIMINATION

COMPLAINT

 

You must initiate an action within five (5) working days of the last occurrence of discrimination/sexual harassment.  Discrimination can be described as being treated differently because of race, ethnicity, religion, disability, or gender.  You must call in advance for an appointment with the EEO Officer.  The process for filing a sexual harassment/discrimination complaint is as follows:

 

1.       Verbally discuss complaint with your immediate supervisor.  If the problem is not resolved or if you feel that you cannot speak with your immediate supervisor to resolve the problem, contact your department head.

 

2.       Verbally discuss your complaint with your department head.  If the problem is not resolved, notify the EEO Officer.

 

3.       If the complaint is against your department head or an employee of another department, you may speak directly to the EEO Officer.

 

4.       Contact EEO Officer regarding your complaint at 482-4290.  In addition you must submit the complaint in writing.  The statement must describe the sexual harassment/discrimination that you have been experiencing and name any witnesses that can corroborate your allegation.  All communication with the EEO Officer will be strictly confidential.  Special arrangements can be made to meet privately off County premises with you if necessary.

 

 

5.       The EEO Officer will then notify the department head and make arrangements for a convenient time and place to conduct interviews.  All interviews will be confidential and no employee will be subject to retaliation.

 

6.       Within ten (10) to twenty (20) working days after the opening date of your claim the EEO Officer will submit the findings and recommend action to the Director of Human Resources.  The Director of Human Resources will send a copy of the report to your department head, to you and the person or persons being filed against.

 

If you do not agree with the recommendation of the EEO Officer you have the right to request a hearing before the Employment Appeals Board (EAB).  The request for an EAB hearing must be filed with the Human Resources Department.  The recommendation of the Employment Appeals Board will be final.
